Our particular areas of expertise include Building Surveys of residential property, acting as an Expert Witness, giving Party Wall advice, Right to Light, and BRE Daylight and Sunlight Reports.
We act for individuals, other consultants plus local and national businesses.
For our Building Surveying services, we generally provide a local service to the North East of England, and parts of Cumbria.
For commercial clients, we will travel all over the country for them at their request.
The Party Wall etc Act 1996 is often overlooked by parties carrying out development work.
For many, this piece of legislation is only learned of when they are just about to start work on site, or for many, when they have already begun.
This can cause problems for both the person(s) undertaking the building works (known as the Building Owner) and also for the neighbour(s) to the person undertaking the work (known as the Adjoining Owner).
You will need to comply with the requirements of The Party Wall etc Act 1996 if you are intending to carry out certain building works to any part of a wall or floor separating different buildings regardless of whether the buildings are residential or commercial.
In the event of a dispute with a neighbour or a building contractor, it is always highly desirable to attempt to settle matters without reverting to Court action but sometimes this is unavoidable.
In such circumstances, there may be the need for the production of a suitable report from an Expert Witness.
To be valid for inclusion within a Court submission, an Expert Witness report must be in compliance with the Civil Procedure Rules part 35 (CPR 35).
With particular respect to Expert Witness reports regarding Boundary Disputes, at Smith Marston, we have up-to-date and highly accurate Nikon Total Station technology, which allows us, in house, to produce extremely accurate plan drawings for use in assessments of boundaries.
We offer a variety of surveys for a range of purposes.
You might be intending to purchase a house and need a full survey or maybe a partial, bespoke survey.
Alternatively, you may wish to be able to plan maintenance for the next few years, or you already own a property and wish to have an inspection of a particular defect which is concerning you.
Beyond the limitations of the Mortgage Valuation Survey, the two standard forms of survey available are the HomeBuyer Survey and the Building Survey.
For most relatively modern, standard properties in generally reasonable condition, the HomeBuyer Report is adequate to advise upon the essential matters of concern.
