Services
Batty France Consultancy had its origins in the late 1960's when Ted Batty and Colin France worked together and developed a business which offered particular expertise for their Clients.
Originally based in an attic in Horsforth [89 Town Street] above their accountants, D'Arcy Howard, expansion meant that the business was relocated to Brighouse.
Recession meant that another re-location to more frugal 2-storey premises above a Guy Watson's in Shipley [Kirkgate] and then a final relocation to extended offices at 1 Rosse Street, Shipley.
During the last 40 years Batty France has worked very successfully on all aspects of QS service.
Our specialist knowledge and experience has adapted to meet constantly evolving market requirements but we always remain focused on our ultimate goal - the delivery of construction projects adhering to the cost and time constraints agreed with our Clients and fellow design team colleagues.
Please take a look at our service pages for more detailed information and do not hesitate to contact us if you feel we can help with your current project.
Following the advent of the Housing Grants, Construction and Regeneration Act 1996 in 1998, Adjudication has grown tremendously in popularity with in excess of 1000 construction adjudication incidences taking place last year.
Adjudication is the single greatest factor to have affected dispute resolution in the construction industry in the UK.
New proceedings issued in the Technology and Construction court have reduced dramatically since adjudication has become available.
At Batty France, we undertake over 100 Adjudication procedures every year, working for Employers, Contractors and Subcontractors alike.
Alternative Dispute Resolution (ADR) includes dispute resolution processes and techniques that fall outside of the government judicial process.
Despite historic resistance to ADR by both parties and their advocates, ADR has gained widespread acceptance among both the general public and the legal profession in recent years.
In fact, some courts now require some parties to resort to ADR of some type, usually mediation, before permitting the parties' cases to be tried.
The rising popularity of ADR can be explained by the increasing caseload of traditional courts, the perception that ADR imposes fewer costs than litigation, a preference for confidentiality, and the desire of some parties to have greater control over the selection of the individual or individuals who will decide their dispute.
Expert evidence is often required in construction disputes and is intended to assist the court when it is asked to consider matters that it does not have a sufficient degree of knowledge on.
Frequently construction disputes can require more than one expert, although the use of expert evidence is restricted to that which is reasonably required to resolve the dispute.
The overriding duty of the expert witness is to assist the court on the matters within their expertise.
This duty supersedes the expert's duty to the party instructing them.
